If you are located in Quebec, you have certain rights with respect to your personal information. The following is a summary of those rights and additional information applicable to our collection and use of your personal information. Quebec’s Act respecting the protection of personal information in the private sector
We have adopted Quebec’s Act Respecting the Protection of Personal Information in the Private Sector, as amended by the recently enacted Law 25 (the “Act” or Quebec’s “Act”) Quebec’s Act governs the way in which we collect, use, disclose, secure and dispose of personal information subject to the Act.

Legal basis for using personal information
We only collect and use personal information for legitimate purposes and as allowed by law. Depending on your individual circumstances, the personal information we hold about you, and the specific purposes for holding your Personal Information, we rely on one of several legal bases to use your personal information. These legal bases include where:
- You provide your prior consent to use your personal information for the purposes for which it was collected, which you may withdraw at any time;
- Your personal information is used by us for other purposes allowable by law which are consistent with the purposes for which it was collected;
- Your personal information is used by us for your benefit;
- The use is necessary to prevent or detect fraud or crime or other statutory offences or to assess or improve security measures;
- The use is necessary to provide or deliver our products, Websites, or Services which you have requested we provide or deliver;
- The use is necessary to comply with a legal obligation, a court order, demand or mandate from a government or legal entity or to exercise or defend legal claims; and
- The use is necessary to perform our contractual obligations, such as to provide you with employment or engagement opportunities, access to our Websites, or to provide you Services.

Personal information concerning minors is not collected
Absent certain circumstances, Quebec’s Act forbids personal information concerning a minor under 14 years of age to be collected without parental consent or consent from another appropriate authority figure. MBO’s Websites and Services are not intended for anyone under 16 years of age. We do not knowingly collect or allow the collection of personal information in connection with our Websites or Services from anyone under the age of 16. If we learn that we have collected the personal information of anyone under the age of 16, we will take appropriate steps to delete this information. If you are a parent or guardian of someone under the age of 16 and discover that your child has submitted personal information to us, you may contact us using the mailing address or phone number provided in the Contact Details and Complaints section below or submit your request to remove your child's personal information from our systems by completing the Individual Data Request Form.

Personal information collected from third parties
As identified above in the Summary of Purposes and Means of Data Collection, from time to time the sources which we may collect personal information from may include third parties such as consumer reporting agencies. Generally, we obtain your consent when collecting your personal information from third parties. However, where permitted by law and subject to Quebec’s Act, we may collect personal information from third parties in the event that the personal information collected is in your interest and cannot be collected by you, or when such collection is necessary to ensure accuracy of your personal information.
Rights under Quebec’s Act
If you are located in Quebec, you have the following rights in respect of your personal information that we hold:
- Right to know the purposes for which personal information is collected. The right to be made aware of the purposes for which your personal information is used and collected prior to use and collection.
- Right of access. The right to obtain confirmation as to whether or not your personal information is held and to access and obtain a copy of your personal information being held.
- Right to rectification. The right to obtain rectification or correction of your personal information where the personal information is inaccurate or incomplete.
- Right to withdraw consent. The right to stop the use and or sharing/dissemination of your personal information, and to remove pages to websites that allow your personal information to be shared or accessed such as your MBO Marketplace profile.
Note: MBO uses your personal information to provide you with Services and process your transactions, such as providing you with engagement and employment opportunities and paying Contractors and Employees for services they may provide to Clients. Therefore, if you would like MBO to continue to provide Services to you, MBO’s collection and use of your personal information is permitted by law including Quebec’s Act since it is necessary to perform our contractual obligations and is authorized by law. Though you may withdraw your consent to the use or sharing of your personal information, this may prevent MBO from providing you with certain Services.

Duration for which we keep your personal information
We reserve the right to retain any information as long as it is needed to fulfill the purposes for which we collected the information, including for the purposes of satisfying any legal, accounting or reporting requirements and to exercise or defend legal claims. In addition, and subject to Quebec’s Act, when personal information is used to make a decision (e.g., for employment or engagement decisions), personal information is kept for at least one year following the decision.

We will treat each complaint confidentially. We will investigate each complaint and will contact the individual that submitted the complaint within a reasonable time period once the complaint is resolved (and in any event within any applicable time period required by law).
Written requests required and we confirm identity before disclosing personal information
Subject to Quebec’s Act, your requests to exercise your rights must be in writing.
Whether submitting a request using the Individual Data Request Form or whether submitting a written request using the mailing address identified above, before disclosing any personal information to you, we will authenticate your identity. If we cannot authenticate your identity, we will err on the side of protecting your personal information. We will inform you in writing of our decision.
